Terms

The deal, in plain words. The two clauses people actually get caught by are seven and nine: an unpaid subscription takes your public page offline, and there is no uptime promise yet. Both are written out rather than buried.

Who this agreement is with

These terms are between you and [TODO: registered legal name], of [TODO: registered address], which runs Tappnest. By creating an account you accept them. If you are agreeing on behalf of a company, you are confirming you are allowed to.

Your account

You need to be at least 16. Use a real email address, because it is how we reach you about your subscription and how you recover a lost password. Keep your password to yourself - anything done from your account is treated as done by you.

What you may publish

Your page is public and carries our name, so there are limits. You must not use Tappnest to publish or link to:

  • Anything illegal where you are, or where your visitors are.
  • Malware, or a page built to steal credentials, payment details or logins.
  • Content pretending to be someone else, or using a brand you have no right to.
  • Material that sexualises children, incites violence, or harasses a particular person.
  • Deceptive money-making schemes, fake stores, or fake charity collections.
  • Anything you do not have the rights to - someone else's photographs, music or writing.

You must also not try to break the product: no attacking it, no scraping other people’s pages in bulk, no working around plan limits, and no reselling Tappnest as if it were yours.

Your link

Links are first come, first served, and some words are reserved for the product. We will reclaim a link if it impersonates a real person or organisation, infringes a trademark whose owner asks us to, or belongs to an account we have terminated under clause 10. Otherwise it is yours while your account is open.

Your content stays yours

You own what you put on your page. You give us only the permission we need to run the product: to store your content, and to show it to anyone who opens your page, for as long as it is published. That permission ends when you delete the content or your account. We do not sell your content and we do not use it to advertise anything without asking you first.

Forms, and the people who fill them in

When you turn on a form you become responsible for the details people send you. Ask for the minimum you need, use it for what you said you would, and write your own privacy notice if the law where your visitors live requires one. Do not use your inbox as a mailing list people never signed up for. We may remove a form that is collecting data deceptively.

How we handle those submissions on your behalf is set out in the privacy page.

Trial, plans and what happens if you stop paying

Every account starts with a 14-day trial at Pro features, with no card required. After that, Starter is $5 a month or $48 a year, and Pro is $12 a month or $120 a year. Prices are in US dollars and exclude any tax that applies where you are.

Payment is taken by Dodo Payments as merchant of record, so your card statement and your invoice come from them. Subscriptions renew automatically at the end of each period until you cancel. Cancelling stops the next renewal; you keep your plan until the period you have already paid for runs out.

Read this one. Your public page is part of what you are paying for. While a payment is failing, your page keeps serving until the end of the period you already paid for. Once that date passes with no successful payment, or once a cancelled subscription runs out, your public page stops loading and returns a not-found page to visitors. Your content, your blocks and your leads are not deleted, and the page comes back the moment a payment succeeds. Keep that in mind before you print the link on anything.

Plan limits are enforced as you go rather than retroactively: dropping from Pro to Starter means you cannot create new pages beyond the Starter allowance, and features that are Pro-only stop being available.

Refunds

[TODO: refund policy] Where you have a statutory right to a refund or to cancel, that right applies regardless of anything here. Refunds are processed by Dodo Payments and may take a few days to reach your card.

What we do not promise

Tappnest is early. We do not offer an uptime guarantee or a service credit yet, and the product is provided as it is, without warranties beyond those the law gives you and will not let us exclude. We will keep backups and we will tell you honestly when something breaks, but if your link absolutely must resolve every second of the day, you should know where you stand.

We will keep changing the product. We may add, change or retire features. If we remove something you are relying on, or discontinue the service altogether, we will give you reasonable notice by email and a way to export your content.

Suspension and ending it

You can stop at any time: cancel in settings, or ask us to close the account entirely. We can suspend or terminate an account that breaches clause 3, that is being used to harm people, or where we are required to by law. Unless the law stops us, we will tell you why and give you a chance to put it right first when the breach is one that can be fixed.

Liability

Neither of us is liable for indirect or consequential loss - lost profit, lost business, lost data where you could reasonably have kept your own copy. Our total liability to you is capped at what you have paid us in the twelve months before the claim. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else the law does not allow to be limited.

Changes to these terms

If we change these terms, we will update this page and its date, and email you at least 14 days before a material change takes effect. Carrying on using Tappnest after that is how you accept the new version; if you would rather not, cancel before it starts.

Law and disputes

This agreement is governed by [TODO: governing law], and [TODO: courts with exclusive jurisdiction] have exclusive jurisdiction over any dispute, except that either of us may seek an injunction wherever necessary. Before filing anything, email us - most of this is solvable in a message.
